By creating an account and subscribing to MyEquipex.com directory listing services, you (“Merchant”) agree to be bound by these Terms and Conditions.
1. DIRECTORY LISTING SERVICES
MyEquipex.com (“Platform,” “we,” “us”) provides business directory listing services including:
Business profile page with contact information and description
Category-based search visibility
Mobile-optimized listing display
Basic analytics on profile views and inquiries
Directory Listing Subscription: $147/month
Optional Paid Ad Placements:
Spotlight (Homepage Ad): $5/day
Top of Search Results: $20/day
Sidebar (Listing Detail Pages): $10/day
2. BILLING AND PAYMENT TERMS
2.1 Subscription Billing
All subscriptions are billed monthly in advance
Billing cycle begins on the date you complete your first payment
Subsequent charges occur on the same calendar date each month
Example: Subscribe on January 15th = next billing date is February 15th
2.2 Payment Processing
Payment is due immediately upon subscription activation
Late payments may result in service suspension after 7 days
Accounts suspended for non-payment beyond 30 days will be terminated
All fees are non-refundable unless otherwise stated
2.3 Price Changes
We reserve the right to modify pricing with 30 days written notice
Existing subscribers will receive grandfathered pricing for 90 days
3. MERCHANT OBLIGATIONS
3.1 Account Information
You must provide accurate, current business information
You agree to update listing details within 30 days of any changes
You must maintain valid contact information and respond to customer inquiries promptly
3.2 Content Standards
All content must be family-friendly and comply with local laws
No false, misleading, or deceptive information about services/products
Professional images and appropriate business descriptions required
We reserve the right to remove content that violates these standards
3.3 Compliance
You must maintain all required business licenses and permits
You agree to comply with all applicable local, national, and international laws
You are solely responsible for the quality and delivery of your services
4. PLATFORM RESPONSIBILITIES
4.1 Service Level
We strive to maintain 99% uptime for the directory platform
Customer support available during business hours (9 AM – 5 PM AST)
Listing updates processed within 48 business hours
4.2 Marketing Efforts
Your listing may be included in general platform marketing
Social media promotion as part of regular content strategy
No guarantee of specific results or lead generation
5. SUBSCRIPTION MANAGEMENT
5.1 Cancellation
You may cancel your subscription at any time through your account dashboard
Cancellation takes effect at the end of your current billing cycle
No refunds for partial months of service
5.2 Account Termination
We may terminate your account for:
Non-payment beyond grace period
Violation of content standards or platform policies
Business closure or license revocation
Fraudulent or illegal activity
6. INTELLECTUAL PROPERTY
6.1 Your Content
You retain ownership of all business content and images you provide
You grant us a non-exclusive license to display your content for directory purposes
You represent that you own or have rights to all content you submit
6.2 Platform Property
We retain ownership of the directory platform, technology, and structure
Our trademarks, logos, and branding remain our exclusive property
7. DATA AND PRIVACY
7.1 Customer Data
Customer inquiry data belongs to you as the merchant
We may use aggregated, anonymized data for analytics and platform improvement
We will not sell or share your personal customer data with third parties
7.2 Privacy Compliance
Both parties agree to comply with applicable privacy and data protection laws

8. DISCLAIMERS AND LIABILITY
8.1 Service Disclaimers
Services provided “as is” without warranties of any kind
No guarantee of specific results, leads, or business outcomes
We are not responsible for the quality of merchant services or customer satisfaction
8.2 Limitation of Liability
Our total liability is limited to the amount of your monthly subscription fee
We are not liable for indirect, incidental, or consequential damages
You agree to indemnify us against claims related to your business operations
9. DISPUTE RESOLUTION
9.1 Governing Law
These terms are governed by the laws of Sint Maarten
Any disputes will be resolved in the courts of Sint Maarten
9.2 Resolution Process
Good faith negotiation between parties
Mediation if direct negotiation fails
Local court jurisdiction as final resort
10. GENERAL PROVISIONS
